GENERAL TERMS OF SALE
These general conditions specify the rights and obligations of CENTRE DE YOGA PARINAMA and the client (hereinafter referred to as “the student”), and are applicable to all services provided inside the Center or organized outside by professors FRANCESCA CORNIA MODONI and LUCA MODONI.
Any service offered by LE CENTRE DE YOGA PARINAMA implies the student’s unreserved acceptance of these general terms and conditions.
The student therefore undertakes to take note of the following internal rules and to respect them in all respects, for the well-being and safety of all.
THE PARINAMA YOGA CENTER reserves the right to modify and correct its General Conditions of Sale at any time and without notice; the applicable conditions are those in force on the date of purchase of the card.
It is the responsibility of the student to consult the current update on www.yogafontainebleau.com
1. DESIGNATION

2. CONDITIONS
2.1. CARDS
Each subscription card is nominative and non-transferable, except exceptions (see 2.1. bis); subscriptions and logbooks are not refundable or transferable.
The validity of each subscription is specified on the price table displayed at CENTRE DE YOGA PARINAMA and on www.yogafontainebleau.com; the validity date of the card cannot be changed.
A subscription or session book that is not used in whole or in part during its subscription period cannot be refunded or offset.
2.1.bis. Exceptions
The sessions of a card or subscription may be given to a third party in two cases:
- if the third is a minor son of 18 years;
- if the third party resides more than 100 km away.
In both cases, after the test session, the documents in point 2.2 will still have to be submitted to the CENTRE.
2.2. DOCUMENTS TO BE SUBMITTED
When purchasing the first card, each student must complete a membership form.
It is the responsibility of the student to consult a doctor before his first session in order to validate the non-contraindication of the practice of Yoga in relation to his state of health.
A medical certificate must be provided within 15 days in the case of a monthly subscription or 10-session card; if the student does not have a medical certificate for the sport activity, it can be replaced by a discharge letter and a health form "QS – SPORT"; in the case of a positive answer to one or more questions of the questionnaire, the student is obliged to provide a Medical Certificate.
The discharge letter is valid indefinitely; it will be the responsibility of the student to communicate any changes in his or her health to the teachers and to compile a new discharge letter and a new health form “QS – SPORT”
If the student does not provide a medical certificate or discharge letter, the student releases LE CENTRE DE YOGA PARINAMA from all responsibilities regarding the physical problems that may arise and concerning him.
2.3. LIABILITY
Each student practices under his own responsibility, including during the handling of accessories (ropes, chairs, wooden tools and all equipment provided during classes) and possible poses as a couple.
We will not be held responsible in case of accident on the premises and whatever the cause.
3. RATES AND PAYMENT TERMS
3.1. TARIFFS
The prices of the various services are available at CENTRE DE YOGA PARINAMA and on www.yogafontainebleau.com; they are indicated in euros and taxes included.
When purchasing the first subscription or entry book, a membership to the Center will be requested; this membership covers the costs of managing the cards, making appointments, etc. The amount of membership is specified on the table of rates displayed at CENTRE DE YOGA PARINAMA and on the site www.yogafontainebleau.com.
The workshp or stages rates will be communicated at the opening of the registration and will vary according to the services offered; the amount must be paid in cash or by cheque (not cashed) at least one week before the date of the internship. In the absence of this advance, registration for the course will not be taken into account and the place will remain available to other interested parties.
Payments are made on the spot by cash or cheque.
3.2. REFUNDS
3.2.1. RIGHT OF WITHDRAWAL
In accordance with article L 121-20 of the Consumer Code, students are informed that they have seven (7) days from the date of purchase of the service to exercise their right of withdrawal, without penalty and without having to justify a reason, provided that no session of the card or subscription has been used.
The right of withdrawal can be exercised by email to: yogableau@gmail.com or by registered letter with acknowledgement of receipt addressed to MODONI LUCA or CORNIA MODONI FRANCESCA, 54, RUE ARISTIDE BRIAND - 77300 – FONTAINEBLEAU.
3.2.2. REFUNDS
- CARDS and MEMBERSHIP IN THE ROOM: no refund will be made.
Cards and subscriptions are registered, non-refundable, non-exchangeable and valid only for the period subscribed.
Once the first session of the first card of the year is used, the membership to the room will not be refunded in any case.
- WORKSHOPS AND STAGES: in case of cancellation due to insufficient number of students or impossibility on the part of teachers, the amount paid at the time of registration will be refunded. The student has the right to cancel his participation with a notice of at least 48 hours, free of charge; beyond this period, the amount will not be refunded in any case.
3.2.3. COURSE CANCELLATION
The CENTRE DE YOGA PARINAMA reserves the right to cancel courses and workshop if there is no minimum number of students or if the teacher is unable to lead the course. In case of cancellation of a course, the session can be used later, within the validity limit of the card or subscription; in case of cancellation of a workshop, the price will be refunded.
The PARINAMA YOGA CENTER reserves the right to permanently cancel classes that have a regular attendance of less than 2 people.
3.2.4. FORCE MAJEURE
FRANCESCA CORNIA MODONI and LUCA MODONI are released from their contractual obligations in the event of a force majeure event, or any fact attributable to a third party, or any other circumstance having an external cause and/ or independent due to the association, preventing it directly or indirectly from performing its contractual obligations normally.
Cases of force majeure shall include, in particular, in addition to cases recognized by the case law, any natural disaster, any act of war, public order attacks, epidemics, fires, floods and other disasters, any governmental act, any strike in any form and any malfunction of the networks.
In the event that a case of force majeure prevents, delays or affects the performance of an obligation, any delay or failure to perform its obligations may not give rise to damages.
FRANCESCA CORNIA MODONI and LUCA MODONI cannot be held responsible for technical problems limiting access to services or damage caused to the student’s equipment.
Rules of procedures
1. Smoking, drinking alcohol and vaping are not permitted inside the premises.
It is forbidden to enter the classroom with shoes on.
Eating inside the courtroom is prohibited.
Students must turn off or silence the cell phones upon entering the PARINAMA YOGA CENTRE. Exceptions to this rule will be possible if required upon request.
2. Students must ensure that their Yoga clothes are clean and have a level of personal hygiene appropriate to the practice; the assessment of whether or not they comply with this regulation is solely up to the teachers and is not open to dispute.
3. Each student must ensure respectful use of room equipment (equipment, accessories, changing rooms, toilets, etc.), especially by ensuring that heavy loads do not fall on the floor during handling.
4. The class room will be available for students to warm up 15 minutes before the group class supervised by the teacher. This preparation of the body is essential for the benefits of the session, as well as for a safe practice. It is strongly recommended that students take advantage of this opportunity.
No student may be admitted to the classroom after a session has started.
5. STUDENT COMMITMENTS AND OBLIGATIONS
Any behaviour that affects his or her own safety, that of others or that would prevent the smooth running of courses, internships and/or workshops, will be punished by the permanent exclusion of the student without the latter being able to claim reimbursement of the sums paid.
FRANCESCA CORNIA MODONI and LUCA MODONI reserve the right to exclude without notice any person who violates the rules of the house or whose conduct would be contrary to the rules of decency or inappropriate to the practice of Yoga.
In these cases no compensation will be possible.
Any dispute, threat, harassment, verbal and/or physical aggression against the teachers, even in the absence of witnesses, will determine the immediate and definitive expulsion from the Centre without the student being entitled to any reimbursement.
The teachers reserve the right to make an unqualified judgment on any student’s inappropriate behaviour.
